General Terms and Conditions of the Online Store PVStore

1. Scope and Purpose of the General Terms and Conditions

These General Terms and Conditions, along with the order form and other referenced elements, aim to regulate the terms and conditions governing the provision of the PVStore Online Store service by BlueMagnitude, headquartered at Rua da Fé, 127, Chãs, 2415-140 Regueira de Pontes, registered under NIF 517949849.

The service consists of making available, through the PVStore website, an online store that provides information about a range of products and/or services, allowing users to order the products presented electronically, under the terms and conditions described herein.

Orders must be placed by users aged 18 or older. Users under the age of 18 must have authorisation from their legal representatives. The information provided by the user holds full legal effect, and the user acknowledges the validity of electronic transactions, waiving any claim of lack of signature as a reason for non-compliance with their obligations.

2. Product Information and Content

PVStore commits to making every effort to ensure that the information presented is free of typographical errors, which will be corrected promptly upon identification. If you purchase a product with characteristics different from those presented online, you may exercise your right to cancel the purchase contract under applicable legal terms (right of withdrawal – see section on returns).

PVStore strives to deliver all ordered products. However, in cases of unavailability due to factors beyond PVStore's control, such as human error or IT issues, you will be contacted, informed of the situation, and given the option to cancel the order with a full refund if applicable.

Prices, product specifications, promotional actions, and services may be changed at any time by PVStore.

3. Responsibilities

All products and services sold on the PVStore Online Store comply with Portuguese legislation.

Although the store employs appropriate security measures, PVStore is not responsible for damages resulting from:

• Delays, interruptions, or errors in communications caused by factors beyond its control;
• Damage caused by malicious software, such as viruses, or downloading infected files;
• Failures in communication networks or third-party computer systems.

PVStore does not guarantee that the service:

• Will be provided uninterruptedly and without errors;
• Will fully meet the user's expectations;
• Will be free from security flaws or interruptions.

PVStore is not liable for indirect damages, including loss of profits, data, or other damages resulting from the use or inability to use the service.

4. Consumer Obligations

The user agrees to:

• Provide accurate personal information and addresses;
• Not use false identities;
• Respect order limits.

PVStore reserves the right to:

• Block access to the store;
• Cancel future orders;
• Restrict access to services for users who violate these obligations.

5. Order Cancellation

5.1. At the User's Request: The user may cancel an order if it has not yet been processed or shipped. The request must be made via email or phone.

5.2. At PVStore's Initiative: PVStore may not process orders if inconsistencies in user data or technical errors in product pricing or description are detected.

6. Returns (Right of Withdrawal)

The user may return purchased products within 15 days, provided the following conditions are met:

• The item must be intact, unused, and accompanied by its packaging, manuals, and all accessories;
• The user must include the corresponding invoice.

If these conditions are not met, the return or exchange will not be accepted.

7. Warranty

All equipment has a minimum warranty of 2 years, unless otherwise stated by the manufacturer. The warranty can only be invoked upon presentation of the invoice and/or warranty certificate.

Products are excluded from warranty coverage if damaged due to:

• Normal wear and tear;
• Improper use;
• Unauthorised technical interventions;
• External factors such as humidity, falls, or electrical surges.

Shipping costs are the responsibility of the user.

8. Intellectual Property

All content on the PVStore is protected by copyright and industrial property rights. Any reproduction or misuse of the content without prior authorisation is prohibited.

9. Suspension and Deactivation of the Store Service

9.1. Regardless of any prior or subsequent communication, PVStore may, at any time, at its sole discretion, discontinue the provision of the Service and/or part of the Service to one or all Users.

9.2. PVStore also reserves the right to suspend or immediately terminate access to the Service in the following cases: a) When the User does not comply with the terms of use outlined in Section 4 and other General Terms and Conditions; b) When PVStore ceases access to the Store, with prior notice of 15 days.

9.3. The suspension or termination of the Service by PVStore, under the terms of the previous paragraphs, does not entitle the User or third parties to any compensation or indemnity, and PVStore cannot be held responsible for any consequences resulting from the suspension, cancellation, or termination of the Service.

9.4. In the situations described above, PVStore will notify the User beforehand, allowing them, if desired, to safeguard the content of their order history within 3 (three) business days of the email notification or the information being made available on the Service's homepage.

10. Communications

10.1. Without prejudice to other communication methods provided in these General Terms and Conditions, notifications to the User regarding the Service, including potential changes to these General Terms and Conditions, may be made to the User's email address, via SMS, or by phone.

10.2. The User agrees to receive all communications and/or notifications related to the Online Store at the address, contact phone number, and/or email address provided during the order process.

At any time, the User may request to stop receiving these communications and/or notifications through the Contact Form or the "Unsubscribe" option available in each Newsletter.

11. Applicable Law

The contract is governed by Portuguese law.
